Terms of Service

By accessing and using Cultural Coder (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

These terms comply with Zimbabwe's Cyber Security Act (Chapter 12:07) and Data Protection Act (Chapter 11:22) as amended.

Cultural Coder is an online learning platform that provides coding education through interactive lessons, AI-powered tutoring, and Zimbabwean language support (Shona and Ndebele).

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without prior notice.

Eligibility: You must be at least 13 years old to create an account. If you are under 18, you confirm that you have parental or guardian consent.

Account Security: You are responsible for maintaining the confidentiality of your account credentials. All activities under your account are your responsibility.

Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information as needed.

You agree NOT to:

• Use the Platform for any unlawful purpose or in violation of Zimbabwean laws
• Attempt to gain unauthorized access to any part of the Platform
• Introduce malware, viruses, or any malicious code
• Interfere with the proper operation of the Platform
• Reproduce, duplicate, copy, sell, or resell any content without permission
• Use automated systems (bots) to access the Platform without written permission
• Harass, abuse, or harm other users

Our Content: All content on the Platform, including lessons, code, graphics, logos, and design, is owned by Cultural Coder or its licensors and is protected by copyright laws.

User Content: You retain ownership of content you submit to the Platform. By posting content, you grant us a worldwide, non-exclusive license to use, reproduce, and display it for platform operations.

Code Examples: Code examples provided in lessons are for educational purposes and may be used freely.

Our AI tutor is powered by Google's Gemini API. While we strive for accuracy, AI-generated responses may contain errors or inaccuracies. The AI tutor:

• Is a supplementary learning tool, not a replacement for human instruction
• May produce unexpected or incorrect outputs despite our safety measures
• Should not be used for medical, legal, or professional advice

The Platform uses third-party services including:

• Firebase (Google): Authentication and data storage
• Google AI (Gemini): AI tutoring capabilities
• Google AdSense: Advertising
• Sentry: Error monitoring

Your use of these services is subject to their respective terms and privacy policies.

Free Tier: The Platform offers a free tier with limited AI queries. This may change at our discretion.

Premium Subscription: Premium features are billed at $2 USD per month via EcoCash. Payments are processed through EcoCash's payment system.

Cancellation: You may cancel your subscription at any time through your account settings. No refunds are provided for partial months.

To the maximum extent permitted by Zimbabwean law, Cultural Coder shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, or business opportunities
• Any errors or interruptions in the Platform
• Any actions taken by third parties

You agree to indemnify and hold harmless Cultural Coder, its operators, and affiliates from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

We may suspend or terminate your account if you violate these Terms or engage in unlawful activity. Upon termination, your right to use the Platform ceases immediately.

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email or Platform notice.

These Terms shall be governed by and construed in accordance with the laws of Zimbabwe. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
